Gay weddings: Will they be legal in June?

The Supreme Court on Friday set in motion its constitutional machinery on the issue of same-sex marriage, probably producing a result in June, the most popular month for weddings. Friday thus marked a bold beginning, especially in the face of the reality that the court could have chosen to stay away from the issue altogether, but deliberately chose not to do so.

350px-Supreme_Court_US_2010But the path from this beginning to the June outcome will be, for the justices, more like finding their way through a garden maze: the end at times will seem quite elusive. And, in this instance, the end might not be a clearly defined one: either that gay weddings will be made legal nationwide, or that states will remain free to ban them if that is their choice.

Between now and one of those clear results, there is a daunting series of turns.? Too much can be made of that fact, though, and that would take away from the historic importance of what the court has begun. Aside from a fleeting look 40 years ago at a legally forlorn plea to allow a Minnesota gay couple to marry, the court until now had never seriously pondered the question.

In the lawyers? coming written arguments, and in the arguments that will unfold in the court?s chamber in March, there will be serious and even profound give-and-take about whether same-sex marriage is or is not constitutionally protected. That is what will hold the attention of most of the public: that?s the issue that the people have been debating for at least a generation, and on which the country?s attitude may be changing, as recent election gains for same-sex marriage have shown after a string of defeats at the polls in all parts of the country.

The court thus will enter the national conversation, and do so at the most fundamental level: What does America?s founding and enduring charter say, or at least what can it be interpreted to mean, on this issue? Those core questions had been laid before the court by the lawyers, and the court said Friday it would consider them.

Still, it is well to remember that what are before the court are court cases, not political conversations or the neighbor?s comments, and those cases have to play out under rules and procedures that are, in fact, constitutionally required.

And when the justices announced their first reaction to the new cases, half of what their orders said told the lawyers to come prepared to argue that the ultimate question is beyond the justices? reach, that it may not have the authority to rule now. To some, that may seem quite baffling: a court this powerful, with almost complete discretion about what it will decide, might not be able to decide at all?

The answer can be found in these words of the Constitution?s Article III: ?The Judicial Power shall extend to all Cases?(and) Controversies?? From President George Washington?s time, when the Supreme Court advised him that the court has no power to give advisory opinions, those words have been understood to mean that the justices can only rule on real, live legal controversies, with two sides that have what the Supreme Court has called ?a direct stake? in the dispute.

The theory behind it is that the meaning of law will develop better in a system of courtly confrontation, what lawyers call an ?adversarial? process. With something real at stake, rather than a merely abstract question, genuine law will get made by the courts.

Here is why that comes into play in the same-sex marriage cases that the court will be reviewing: The justices are not sure that the parties bringing the cases to them have ?a direct stake? in the outcome. They surely have an interest, but is that enough?

In the California case, the constitutionality of the state?s ?Proposition 8? withdrawal of the right of gays and lesbians to marry was an issue taken to the court by the sponsors of that ballot measure.

In agreeing to take on that plea, the court?s order told lawyers to add to what they say on the constitutional issue their competing views on whether referenda sponsors can show that they will suffer legal harm if their measure is struck down, and that a victory in court will actually remedy that harm. The court, in a 1997 decision, raised ?grave doubt? that sponsors can be in court to defend their measure.

Thus, if the sponsors are not the right party to raise the constitutional issue, there is no one in court to defend ?Proposition 8,? so the court can?t decide it.

In the separate federal lawsuit, the constitutionality of the Defense of Marriage Act?s limitation of marital benefits to unions of a man and a woman was a question taken to the court by the Obama administration (the executive branch) and by the Republican leaders of the House of Representatives. The executive branch no longer defends the act, and so the GOP leaders of the House have taken up that cause.

In agreeing to take on that case, the justices said they wanted to hear arguments on whether they can decide the case at the request of the executive branch, because it won what it sought in a lower court decision striking down the marriage benefits restriction.? And they called for arguments on whether the House Republican leaders have a direct stake that justified their coming to court to defend the act.

If neither the government nor the lawmakers are properly before the court, it would seem, that particular DOMA case could be out of judicial reach.

The fact that the justices asked those up-front questions does not mean, of course, that they will rule in the end that they cannot rule. But it does set the stage for an inquiry that is likely to say something of real importance about judicial power under Article III.

At some point, it remains a strong likelihood that there will be same-sex marriage cases that, in fact, the court can decide. That just may not be in the term that runs through June. But, in the meantime, there will have been a kind of judicial seminar on the constitutional issues surrounding same-sex marriage, contributing to the national dialogue.

Australian DJs break silence over royal prank tragedy

CANBERRA (Reuters) - Two Australian radio announcers who made a prank call to a British hospital treating Prince William's pregnant wife Kate broke a three-day silence on Monday to speak of their distress at the apparent suicide of the nurse who took their call.

The 2DayFM Sydney-based announcers, Mel Greig and Michael Christian, said the tragedy had left them "shattered, gutted, heartbroken".

Greig and fellow presenter and prank mastermind Christian have been in hiding since nurse Jacintha Saldanha's death and the subsequent social media outrage at their prank.

Their show, "Hot 30," has been terminated, the station's parent company, Southern Cross Austereo (SCA), said in a statement Monday. SCA also announced a company-wide suspension of prank calls.

Greig told Australian television her first thought when told of Saldanha's death was for her family.

"Unfortunately I remember that moment very well, because I haven't stopped thinking about it since it happened," she said, amid tears and her voice quavering with emotion. "I remember my first question was 'was she a mother?'"

"I've wanted to just reach out to them and just give them a big hug and say sorry. I hope they're okay, I really do. I hope they get through this," said a black-clad Greig when asked about mother of two Saldanha's children, left grieving their mother's death with their father Ben Barboza.

Saldanha, 46, was found dead in staff accommodation near London's King Edward VII hospital on Friday after putting the hoax call through to a colleague who unwittingly disclosed details of Kate's morning sickness to 2DayFM's presenters.

A recording of the call, broadcast repeatedly by the station, rapidly became an internet hit and was reprinted as a transcript in many newspapers.

But news of Saldanha's death sparked the Internet firestorm, with vitriolic comments towards the DJs on Facebook and Twitter.

Christian said his only wish was that Saldanha's grief-stricken family received proper support.

"I hope that they get the love, the support, the care that they need, you know," said Christian, who like Greig struggled to talk about the tragedy.

Both Greig, 30, and Christian were relatively new to the station, with Greig joining in March and Christian having been in the job only a few days before the prank call after a career in regional radio.

Greig said she did not think their prank would work.

"We thought a hundred people before us would've tried it. We thought it was such a silly idea and the accents were terrible and not for a second did we expect to speak to Kate, let alone have a conversation with anyone at the hospital. We wanted to be hung up on," she said.

Christian drew headlines only two weeks before the royal prank call by angering fellow passengers with a harmonica playing stunt aboard pop star Rihanna's private jet.

SCA, 2Day's parent company, has received more than 1,000 complaints from Australians over the actions of the popular presenters, who have both been taken off air during an broadcasting watchdog investigation.

"SCA and the hosts of the radio program have also decided that they will not return to the airwaves until further notice," SCA said in a statement.

Shares in SCA fell 5 percent on Monday after two major Australian companies pulled their advertising with the radio station in protest and other advertising was suspended.

The station said it had tried to contact hospital staff five times over the recordings.

"It is absolutely true to say that we actually did attempt to contact those people on multiple occasions," said SCA chief executive Rhys Holleran.

"No one could have reasonably foreseen what has happened. I can only say the prank call is not unusual around the world," he said.

The fallout from the radio stunt has brought back memories in Britain of the death of William's mother Diana in a Paris car crash in 1997 and threatens to cast a pall over the birth of his and Kate's first child.

Australia's Communications Minister Stephen Conroy sought to deflect calls for more media regulation, telling journalists that a looming investigation by Australia's independent regulator should be allowed to happen without political interference.

Typhoon Bopha Leaves Hundreds Of Fishermen Missing In Philippines

NEW BATAAN, Philippines -- The number of people missing after a typhoon devastated parts of the southern Philippines jumped to nearly 900 after families and fishing companies reported losing contact with more than 300 fishermen at sea, officials said Sunday.

The fishermen from southern General Santos city and nearby Sarangani province left a few days before Typhoon Bopha hit the main southern island of Mindanao on Tuesday, triggering flash floods that killed more than 600, Civil Defense chief Benito Ramos said.

Ramos said the fishermen were headed to the Spratly Islands in the South China Sea and to the Pacific Ocean. He said there has been no contact from them for a week.

"We have declared them missing," he said. "Maybe they are still alive."

Ramos said they may have sought shelter on the many small islands in the Spratlys and the Celebes Sea, and lost battery power and have not been able to call.

He said the coast guard, navy and fishing vessels have launched a search.

After slamming into the southern Philippines, the typhoon moved out to sea but then veered back toward the country's northwest on Saturday, prompting worries of more devastation. As of late Sunday, however, it had begun to dissipate and weaken into a low pressure area as it moved farther into the South China Sea, about 105 kilometers (65 miles) west of the Philippines' Ilocos Norte province.

Rescuers continued searching for bodies or signs of life under tons of fallen trees and boulders in the worst-hit town of New Bataan, where rocks, mud and other rubble destroyed landmarks, making it doubly difficult to search places where houses once stood.

Hundreds of refugees, rescuers and aid workers took a break Sunday to watch the Manny Pacquiao-Juan Manuel Marquez fight on a big TV screen, only to be dismayed by their hero's sixth-round knockout.

Elementary school teacher Constancio Olivar said people fell silent when Pacquiao, who comes from the southern Philippines where the storm hit, fell heavily to the canvas and remained motionless for some time.

"It was like a double blow for me ? this disaster and this defeat," said Olivar, whose house was destroyed in the storm. "We were all crestfallen. Everyone fell silent, stunned. It was like we saw a tsunami."

Nearly 400,000 people, mostly from Compostela Valley and nearby Davao Oriental province, have lost their homes and are crowded inside evacuation centers or staying with relatives.

President Benigno Aquino III declared a state of national calamity on Friday, which allows for price controls on basic commodities in typhoon-affected areas and the quick release of emergency funds.

Officials said Sunday that 316 people were killed in Compostela Valley, including 165 in New Bataan, and 301 in Davao Oriental. More than 45 people were killed elsewhere. Nearly 900 are missing, including the fishermen and 440 from New Bataan alone.

Davao Oriental authorities imposed a curfew there and ordered police to guard stores and shops to prevent looting.

The typhoon destroyed about 18 percent of the banana plantations in Mindanao, causing losses estimated at 12 billion pesos ($300 million), according to Stephen Antig, executive director of the Pilipino Banana Growers and Exporters Association.

The Philippines is the world's third-largest banana producer and exporter, supplying international brands such as Dole, Chiquita and Del Monte.

Mormon Church Revises Stance On Gays!

The Mormon Church has revised their stance on gays, and we don't even mean they made it worse: they made it better. They have called for compassion toward gays and acknowledge that it is NOT a choice!

The Mormon Church launched a new campaign encouraging its members to be more compassionate toward the LGBT community and to "love one another." Here's what the official statement from the new church website reads:

The experience of same-sex attraction is a complex reality for many people. The attraction itself is not a sin, but acting on it is. Even though individuals do not choose to have such attractions, they do choose how to respond to them. With love and understanding, the Church reaches out to all God?s children, including our gay and lesbian brothers and sisters.

Well? it's a start at least. Church leaders still insist that "they aren't changing the Mormon teaching that same-sex relationships are sinful."

While we'd absolutely like a 180 from their original stance, we don't think it'll happen over night. Can you imagine how many of their followers would have blown minds?

This isn't a HUGE win in the fight for equality, and it still continues. But, we sure as hell will take all the little ones we can get on the way to winning the war!

Te'o and Manziel hit Manhattan with Heisman hopes

NEW YORK (AP) ? Notre Dame linebacker Manti Te'o was looking forward to a break after a five-city-in-five-days tour, during which he has become the most decorated player in college football.

"I'm just trying to get a workout in and get some sleep," he said Friday about his plans for the night.

Texas A&M quarterback Johnny Manziel seemed to have more energy when he arrived at a midtown Manhattan hotel with his fellow Heisman Trophy finalist. In fairness, Johnny Football's week hasn't been nearly as hectic, though this trip to New York city is different from the first time he visited with his family when he was young.

"It's just taking it up a whole 'nother level, but happy to be here," he said.

Manziel and Te'o spent about 30 minutes getting grilled by dozens of reporters in a cramped conference room, posed for some pictures with the big bronze statue that they are hoping to win and were quickly whisked away for more interviews and photo opportunities.

Manziel, Te'o or Collin Klein, the other finalists who couldn't make it to town Friday, each has a chance to be a Heisman first Saturday night.

Manziel is trying to be the first freshman to win the award. Te'o would be the first winner to play only defense. Klein would be Kansas State's first Heisman winner.

Manziel and Te'o were on the same flight from Orlando, Fla., where several college football awards were handed out last night. The 6-foot-1, 200-pound quarterback was just happy the 255-pound linebacker didn't try to record another sack when they met.

"He's a big guy," Manziel said, flashing a big smile from under his white Texas A&M baseball cap. "I thought he might stuff me in locker and beat me up a little bit."

The two hadn't had much time for sightseeing yet, but they did walk around Times Square some, saying hello to a few fans. They probably weren't too difficult to spot in their team issued warm-up gear.

"We've just been talking about goofy stuff. Playing video games. Playing Galaga. Just some things from back in the day. Messing around with each other," Manziel said. "Kind of seeing who is going to take more pictures. He's definitely taking that award right now."

Te'o is already going to need a huge trophy case to house his haul from this week. He has won six major awards, including the Maxwell as national player of the year. He'll try to become Notre Dame's eighth Heisman winner and first since Tim Brown in 1987.

"I can only imagine how I would feel if I win the Heisman," he said.

Charles Woodson of Michigan in 1997 is the closest thing to a true defensive player winning the Heisman. Woodson was a dominant cornerback, but he also returned punts and played a little receiver. That helped burnish his Heisman credentials.

Te'o is all linebacker. He leads the top-ranked Fighting Irish with 103 tackles and seven interceptions.

Klein was the front-runner for the Heisman for a good chunk of the season, but he played his worst game late in the season ? in a loss at Baylor ? and the momentum Manziel gained by leading Texas A&M to victory at Alabama has been tough to stop.

Manziel's numbers are hard to deny. He set a Southeastern Conference record with 4,600 total yards, throwing for more than 3,000 and rushing for more than 1,000.

Klein, by comparison, averages about 100 fewer total yards per game (383-281) than Manziel.

A freshman has never won the Heisman. Oklahoma running back Adrian Peterson came closest in 2004, finishing second by Southern California's Matt Leinart.

Manziel is a redshirt freshman, meaning he attended Texas A&M and practiced with the team but did not play last year. Still, he'd be the most inexperienced college player to win the sport's most prestigious award.

"It's surreal for me to sit here and think about that this early in my career," he said. "With what me and my teammates have gone through, with how they've played and how they've helped me to get to this point, it's just a testament to how good they are and how good they've been this year.
